Thane: Court Adjourns Distribution Of Houses Under Zopu Scheme To Ineligible Beneficiaries In Dombivli

Dombivli, 31st March 2023: Kalyan Dombivli Municipality should not provide houses to ineligible beneficiaries of Duttnagar in Dombivli in Indiranagar slum in Patharli without a court order. What criteria did the municipality qualify for ineligible beneficiary houses? A detailed report of this should be submitted to the High Court by the State Government and the Kalyan Dombivli Municipality. Ordering that houses should not be allotted to any beneficiary till then, Bombay High Court in-charge Chief Justice Sanjay Gangapurwala, Justice Sandeep Marn stayed the municipal decision to allot houses to ineligible beneficiaries on Friday.

90 ineligible beneficiaries of Dattanagar Ward should be given temporary housing under the Slum Rehabilitation Scheme at Patharli in Dombivli as a very urgent matter. Last month Municipal, by putting political pressure on Bhausaheb Dangde from a senior level, former corporator Rajesh More made a strong effort to provide houses to the ineligible beneficiaries in Indiranagar Zopu Yojana with the help of the municipal officials. If the municipality starts giving houses to ineligible beneficiaries, the city will take the wrong step. Anyone will come forward to ask for houses in the Utsutsu Zopu Yojana. Considering this, a public interest litigation was filed in the High Court by Siddhi Bhosle last month. The court took serious note of the petition.

As the rate of ineligible beneficiaries increased for possession of houses on Rajesh Moren, they were pressing the administration to allot houses to the ineligible beneficiaries at any cost. Last week, out of 90 ineligible beneficiaries, 75 houses were allotted by the municipality for distribution. When the public interest litigation was filed, since the municipality did not take notice of it, during the hearing of this petition on Friday, Adv. Dadichi Mhaispurkar, Adv. Siddhi Bhosle argued in court and pointed out that the administration is willing to give houses to ineligible beneficiaries. At this time, consultant lawyers Adv. A. S. Rao and Adv. Manish Pable were present.

The court heard the arguments of the petitioner’s counsel as to what criteria the municipality laid down to qualify the ineligible beneficiaries in Dattanagar. The state government and municipality should file a detailed report on how they became eligible for this scheme in the court and ordered that the administration should not take any decision regarding the allotment of houses till 2nd May.

This order has once again set back the efforts of former corporator More to provide houses to the ineligible beneficiaries. Most ineligible beneficiaries live in buildings and chalis in different parts of the city.

“The court has ordered the government, the municipality to file a detailed report on how the ineligible beneficiaries were qualified. The court has made it clear that houses should not be allotted until then,” said Adv. A. S. Rao, Adviser, Kalyan-Dombivli Municipality.

“The beneficiaries who were previously ineligible, then the municipality has planned to decide the eligible beneficiaries and give them houses by drawing lots. We demanded an adjournment of the matter. The court has ordered the government and municipal bodies to file a detailed report. Until then, the municipality has been banned from visiting the houses,” said Adv. Dadichi Mhaispurkar, Advocate for the Petitioner.
