Mumbai: Action To Be Taken Against Unauthorized Constructions On MHADA Land

Mumbai, 14th April 2023: For any kind of unauthorized construction on land owned by the Maharashtra Housing and Area Development Authority (MHADA), it will now be mandatory to take permission from MHADA’s Building Department.

A criminal case will be registered against the builder for constructing without permission and punitive action will be taken. MHADA has taken this decision to prevent unauthorized construction.

A lot of unauthorized constructions have taken place on the land owned by MHADA. Unauthorized construction in Mumbai has become a matter of concern for the Board.

In this background, MHADA has now decided to strictly implement the provisions of the Maharashtra Urban Planning Act (MRTP Act) 1966 to curb unauthorized constructions. Accordingly, now it will be mandatory to take permission from the Building Department of MHADA for any kind of construction on the land owned by MHADA. The construction done without taking such permission will be declared unauthorized and will be demolished through the Regional Designated Officers of MHADA.

A criminal case will be filed against the owners, occupiers, their contractors who are responsible for the unauthorized construction as well as those aiding and abetting such construction. All expenses incurred for the demolition of unauthorized construction will be recovered from the concerned person.

As MHADA acquired the right of the special planning authority, the government has provided the authority of special planning authority i.e. approval of construction maps. The authority of the Mumbai Municipal Corporation regarding the MHADA has been terminated.

Accordingly, a separate encroachment removal cell has now been activated by the Mumbai Board to demolish unauthorized constructions and take penal action. Since the establishment of this chamber, massive action has been taken against unauthorized construction by this chamber.

The Mumbai Board has now formed a special task force to take action against unauthorized construction on MHADA land in Mumbai and to prevent unauthorized construction.

If a complaint is received by this Bharari team, it will be necessary to inspect the site and submit a factual report of the situation at the site, along with hand maps, photographs, and original documents from the concerned regional office, and submit a factual report to the head office of the Encroachment Removal Department within seven days. Further relevant action will be taken by this team.
