BMC Imposes Rs 1,000 Fine for Open Burning of Waste from April 1

Mumbai, 28 March 2025: The Brihanmumbai Municipal Corporation (BMC) has announced a fine of Rs 1,000 for open burning of waste in its jurisdiction, replacing the previous penalty of Rs 100. The decision aims to address air pollution and health hazards caused by the practice. Implementation will begin on April 1, 2025, and enforcement will be handled by teams formed at the ward level, including a junior supervisor from the Solid Waste Management Department, a nuisance detector (ND staff), and a Mukadam.

According to the Brihanmumbai Sanitation and Health Bye-Laws 2006, framed under Section 462 (EE) of the amended Mumbai Municipal Corporation Act 1888, burning of waste is prohibited, with violators previously facing a Rs 100 fine. The increase in the penalty is intended to ensure stricter compliance. The move is part of efforts led by Municipal Commissioner and Administrator Bhushan Gagrani and Additional Municipal Commissioner (City) Ashwini Joshi.

BMC officials highlighted that open burning releases toxic gases and particulate matter, degrading air quality and causing respiratory issues. The low fine of Rs 100 was considered insufficient to deter violators. Deputy Commissioner (Solid Waste Management) Kiran Dighavkar stated that the tenfold increase aims to curb the practice more effectively.

Under Rule 5.10 of the Brihanmumbai Sanitation and Health Bye-Laws, 2006, burning waste, especially on open plots, construction sites, and roadside areas, is a common violation. The new fine of Rs 1,000 will be imposed on violators caught in the act. The enforcement team will regularly monitor high-risk areas, impose fines on the spot, and educate citizens about environmental conservation.
