No Welcome for Dalit CJI? Justice Gavai Criticizes Maharashtra’s Top Brass Over Absence

Mumbai, 19th May 2025: Chief Justice of India (CJI) BR Gavai expressed displeasure over a breach in protocol during his maiden visit to Maharashtra after assuming office. Despite the significance of the occasion, neither the Chief Secretary, Director General of Police (DGP), nor the Mumbai Police Commissioner were present to receive him or attend his official event.

Justice Gavai is the second Dalit to be appointed Chief Justice of India and the first from Maharashtra to ascend to the country’s top judicial position.

Justice Gavai, who was sworn in as the 51st Chief Justice of India on May 14, visited Mumbai to attend a felicitation ceremony organized by the Bar Council of Maharashtra and Goa. The absence of top state officials during his arrival and at the ceremony drew sharp remarks from the CJI.

Addressing the gathering, Justice Gavai acknowledged the lapse, clarifying that he did not wish to dwell on minor matters. However, he emphasized the need for mutual respect among the three pillars of democracy — the Executive, Legislature, and Judiciary. “All pillars of democracy are equal and should respect each other,” he said.

In a pointed remark, the CJI added, “Had there been someone else in my place, the provisions of Article 142 might have been invoked.” Article 142 of the Constitution empowers the Supreme Court to pass any order necessary to ensure complete justice in any case, including compelling presence or enforcement when warranted.

The comment underscored the seriousness of the protocol breach and highlighted the importance of observing due courtesy towards constitutional authorities. Justice Gavai’s remarks have since sparked discussions about administrative protocol and the coordination between the judiciary and state machinery.
As of now, the Maharashtra government has not issued any official response.
