Pune Family Court Approves Mutual Divorce in 23 Days, Grants Father Custody of Minor Daughter
Pune, 23rd July 2026: A family court in Pune granted a decree of divorce by mutual consent within just 23 days after a couple reached a comprehensive settlement on the custody and welfare of their minor daughter.
According to the order passed by Civil Judge S. N. Ratkanthwar-Jawadwar, the permanent custody of the girl will remain with her father. However, the mother has been granted the liberty to approach the court for custody in the future if the child is found not to be receiving proper care.
The court also granted the mother visitation rights for two days every month and permitted her to spend time with her daughter during the Diwali or summer vacations. It further directed that the jewellery belonging to the child cannot be sold until she attains adulthood.
The couple, whose identities have been withheld to protect the privacy of the minor, married in October 2021 and have a daughter. Owing to differences in their outlook, lifestyle and frequent disputes, they had been living separately since January 2024.
Efforts by family members to reconcile the couple, along with counselling through the court, failed to resolve their differences. They subsequently filed a joint petition seeking divorce by mutual consent under the Hindu Marriage Act.
Before the court, both parties submitted a written settlement covering child custody, visitation rights, jewellery, maintenance and property-related issues. As part of the settlement, the wife waived her claims to maintenance, residence and any rights over her husband’s property.
After satisfying itself that both parties had entered into the settlement voluntarily and that the welfare and interests of the child had been adequately safeguarded, the court allowed the petition and granted the decree of divorce.
Advocate Ajit Pawar, who represented the couple, said the comprehensive settlement enabled the court to dispose of the matter expeditiously, sparing both parties from prolonged litigation.
